WASHINGTON, D.C. — In a 5-4 ruling, the Supreme Court of the United States today issued an opinion allowing the Biden administration to end “Remain in Mexico,” an unlawful, Trump-era policy that has resulted in mass human suffering and abuses against people seeking asylum at the U.S.-Mexico border.

The following statement is from Andrea Carcamo, policy director with Freedom for Immigrants.

“Since the very beginning, the racist and unlawful ‘Remain in Mexico’ policy has created a humanitarian disaster and inflicted unimaginable harm upon Black and brown immigrants. Following today’s long-overdue victory, the Biden administration must swiftly end ‘Remain in Mexico’ once and for all and allow all those who have been subject to the policy to fight their cases from the safety of community within the U.S.

“To make good on its promise to build a humane immigration system, the administration should approach this victory as only the beginning of the work that lies ahead. We call on President Biden to end the slew of other deadly deterrence policies that his administration has inexcusably kept in place.

“We refuse to accept the status quo, which will inevitably result in more harm and loss of life, whether it be mass tragedies like that of earlier this week in San Antonio, or the shamefully normalized occurrences of death in the Rio Grande and immigration detention centers alike.

“To build on the progress of terminating ‘Remain in Mexico,’ the administration must follow through with its revocation of Title 42, work with Congress to reduce border militarization funding and end the shameful and abusive mass immigration detention system. By making these shifts, we can work to restore asylum and build an immigration system grounded in humanity and dignity for all.”
